DISBANDMENT OF THE YET TO BE INAUGURATED NDDC BOARD AND THE APPROVAL OF THE INTERIM MANAGEMENT COMMITTEE: AN APPLAUD TO PRESIDENT MUHAMMADU BUHARI.FUNORORO

We the members of Citizens Right Advocacy Group (CRAG) in Nigeria wish to applaud and thank President Muhammadu Buhari for the disbandment of the yet to be inaugurated NDDC Board and the approval given to the Interim Management Committee to continue with its forensic audit and the management of the board.




It is evidently clear without bias that the composition, clearance and confirmation of the yet to be inaugurated board was an aberration and against the Act establishing the NDDC. Now that the President has given a positive nod to Interim Management Committee, the members of the Committee should not spare anybody found culpable in their audit no matter the status of the person.

We are very prepared to be abused, maligned and misunderstood by some persons for the positions of the NDDC Board because we know the truth and what the law says. It is better to be vindicated at last than to be applauded wrongly at the moment.

We call on President Buhari to follow the NDDC Act to its letter in the recomposition of the Board without recourse to political manipulations. For the avoidance of doubt, Section 4 of the NDDC(Establishment) Act, 2000 states that " The office of the Chairman shall rotate amongst the member states of the Commission in the following alphabetical order--
    (a) Abia State
    (b) Akwa Ibom State
    (c) Bayelsa State
    (d) Cross River State
    (e) Delta State
    (f) Edo State
    (g) Imo State
    (h) Ondo State
    (I) Rivers State
The position of the Chairman of NDDC is therefore to be produced by Delta State since a, b and c has produced theirs. It is not a right to be negotiated and bargained for.

We want to also use this opportunity to draw Mr President's attention to Section 12 of NDDC (Establishment) Act, 2000 which states that "There shall be for the Commission, a Managing Director, and two Executive Directors who shall be indigenes of oil producing areas starting with the member states of theCommission with the highest production quantum of oil and shall rotate amongst member states in the order of production "

Going by the above provision, the next Managing Director of the NDDC is to be produced by Ondo State which is ranked fifth among the nine states under NDDC. The Act did not say the rotation should be amongst major oil producing states as believed by some persons but amongst member states in the order of highest production quantum.

It is without iota of doubt that Delta, Bayelsa, Rivers and Akwa Ibom States have produced the position of Managing Director. Ondo state which is ranked fifth among the NDDC states has been neglected over the years in spite of the statutory provision as contained in the NDDC Act. 
President Muhammadu Buhari should therefore abide by the provisions of law and appoint an indigene of an oil producing area of Ondo state as the next substantive Managing Director of the Niger Delta Development Commission for the sake of equity, fairness and justice.

It is out of place for Delta and Bayelsa States to jostle for the position of Managing Director since they have gotten a share of it. Let us stand for truth and justice. Stop saying yes to everyone. Stop agreeing to vital issues just because you don't want to upset certain persons. Start protecting what is right and never look back.
